2022-2023 Survey of Attorney Perceptions of Business-to-Business Arbitration

RAND, a non-profit, non-partisan research institution, is conducting a study of business-to-business arbitration in the United States, and as part of that work, is respectfully inviting you to take part in an important survey (you do not need personal experience in business-to-business arbitration to participate). The goal of this effort is to better understand attorney views related both to the inclusion of arbitration clauses in contracts negotiated between companies and to the manner in which arbitrations arising out of such clauses are conducted. RAND has long been dedicated to making the civil justice system more efficient and more equitable by supplying policymakers with the results of objective, empirically based, analytic research. For more information about RAND’s work in the civil justice and dispute resolution policy arenas, please see the RAND Institute for Civil Justice website.

You have been chosen to participate in this survey because you have been identified as having practiced law in your state. The survey is voluntary, and RAND will use the information you provide for research purposes only. We will not disclose your identity or contact information, nor will we identify you or your responses to anyone outside of the project without your express permission, except as required by law.

If you have not already received an emailed link to access this on-line survey, one will be sent to you soon. We estimate that it will take you approximately 30 minutes to answer all the questions, but you are able to start the survey, stop when you so choose, and later return to finish.

Please note that you will receive the survey invitation from our email vendor MailClickConvert, but the survey itself and all information collected will be exclusively controlled by RAND.

Your help will be greatly appreciated and a link to the final report will be sent to all who have answered the survey when this work has been completed. Should you have any questions about the study or your participation in this survey, please do not hesitate to reach out to the undersigned at arbsurveyquestions@rand.org.

Thank you for your consideration of our request.
